The Supreme Court has reaffirmed that citizenship disputes in Assam must be decided through a fair and transparent legal process, stressing that every individual deserves a proper hearing before being deprived of their rights.
Hearing petitions related to cases before the Foreigners Tribunals, the court observed that orders declaring a person a foreigner must be well-reasoned and based on careful examination of the evidence. It said such decisions have life-changing consequences and cannot be taken casually or without following the principles of natural justice.
The Bench also directed that individuals declared foreigners should not face deportation or other coercive action while they continue to pursue legal remedies. The court said authorities must ensure that affected persons are given adequate opportunity to challenge tribunal orders before higher courts.
The observations come amid concerns over the functioning of Foreigners Tribunals in Assam, where several petitioners have questioned the fairness of proceedings and the reasoning behind some orders. The Supreme Court noted that transparency and accountability are essential in matters involving citizenship.
Legal experts believe the ruling strengthens procedural safeguards for thousands of people whose citizenship cases are pending. While the judgment does not alter the existing citizenship laws, it reinforces that authorities must follow due process and issue reasoned decisions before taking action.
