The US Citizenship and Immigration Services (USCIS) has announced a significant reduction in the validity of work permits, known as Employment Authorization Documents (EADs). Effective December 5, 2025, most new and renewed EADs will be valid for 18 months instead of the previous five-year duration.
Existing permits issued under the old rules will remain valid until their scheduled expiry, but the shorter period applies to all applications and renewals submitted after the effective date.
The change affects a wide range of non-citizens, including refugees, asylum seekers, individuals awaiting deportation relief, and applicants for adjustment of status, including those on the path to obtaining a green card. Certain humanitarian-status holders, such as parolees and Temporary Protected Status (TPS) beneficiaries, may also be impacted depending on the duration of their underlying status.
USCIS explained that the reduction is aimed at allowing more frequent background checks and vetting, with the goal of preventing fraud, identity-related risks, and potential security threats. The agency emphasized that working in the U.S. is a “privilege, not a right,” and described the updated policy as a necessary step to safeguard national security.
For immigrants and foreign workers, the 18-month limit means more frequent renewals, increased paperwork, and potential gaps in employment authorization, especially for those awaiting green-card approval. Employers relying on migrant labor may also face added administrative challenges.
Advocates have expressed concern that the change could create uncertainty for thousands of workers, particularly those from countries like India, who form a significant portion of the professional workforce in the United States.
While existing EAD holders can continue working until their permit expires, those applying or renewing after December 5 must plan for shorter validity, more frequent renewals, and additional administrative requirements.
